Rental terms

These terms apply to every scooter hire through Kruk op Wielen. They are deliberately short and in plain English — if anything is unclear, just ask before you rent. Note that the contract is governed by Dutch law.

01 Who you are renting from

  • Kruk op Wielen, Teilingerstraat 126, 3032 AW Rotterdam, the Netherlands. Registered with the Dutch Chamber of Commerce (KvK) under number 63107015. The VAT number is at the bottom of every page.
  • Reachable by email at hoi@krukopwielen.nl. There is deliberately no phone number on the site: you get my direct number at delivery, so you can always reach someone during your hire.
  • In these terms "we" means Kruk op Wielen, and "you" means the person hiring the scooter.

02 Who can rent

  • You are 18 or over.
  • You can sit, steer and brake unaided. We ride a lap together at delivery; if it turns out not to be safe, the hire does not go ahead and you pay only the delivery cost.
  • You do not ride under the influence of alcohol, drugs, or medication that affects your ability to ride.
  • You do not let anyone else ride it without agreeing that with us first.

03 Requesting and confirming

  • A request through the site is not yet a booking. It becomes final only once we have confirmed it by email or message.
  • Until then you can withdraw at no cost, and we may decline a request — for instance if nothing turns out to be free.

04 Prices and payment

  • The price you see when requesting is the price. All amounts include VAT.
  • You pay on delivery, by iDEAL link or cash. Nothing is payable when you request, and you leave no card details anywhere.
  • For hires longer than a month we agree a monthly payment moment.

05 Deposit

  • You pay a deposit on delivery. It covers damage or loss, and you get it back.
  • We return it within five working days of collection, less any cost for damage that falls outside normal wear.
  • If we withhold anything, we email you what it was and what it cost, with photographs.

06 Delivery and collection

  • Within the municipality of Rotterdam, delivery and collection are free. Outside it we charge based on distance, which you see before you request.
  • We agree a time window together. Make sure you or someone else is there — if nobody is, we have to make the trip again and we pass that cost on.
  • At collection we look the scooter over together.

07 How to treat it

  • Use the scooter for what it is meant for: carrying people within the maximum load of 150 kg. That is a total — rider, any passenger on the extra seat, and luggage combined.
  • There is a small extra seat. Taking someone along is fine, as long as you stay within that 150 kg and ride gently. Not on the pavement, and not in heavy traffic.
  • No towing, no stairs, no seawater, no racing.
  • Lock it when you leave it. The lock comes with it.
  • Charge it with the supplied charger from an ordinary socket, preferably indoors or under cover.
  • Do not work on it yourself. If something is wrong, call us — that is what we are for.

08 Where you may ride

  • Use the cycle path, and the road where there is no cycle path. On the pavement, walking pace and around pedestrians. The scooter does roughly 18 kilometres per hour.
  • Important to know: this scooter is not RDW-approved and carries no registration plate. Plenty of comparable vehicles are in use in the Netherlands, but formally you use it on your own responsibility. We state this explicitly in advance so that the choice is yours to make.
  • You are responsible for obeying traffic rules. Fines or measures arising from your use are at your expense.

09 Breakdown and normal wear

  • Something failing through normal use or wear is on us. Call us — you have had our number since delivery — and we come out to fix it or swap the scooter.
  • Always report damage straight away, even if you think it is minor. For damage you report yourself that turns out to be normal wear, we never charge anything.

10 Damage to the scooter

  • We pay the first €200 of repair costs. Anything above that is at your expense, up to a maximum of €400.
  • Damage to the scooter never costs you more than €400, even if the repair is more expensive or the scooter is written off. That limit applies per hire period.
  • The limit falls away only in cases of intent, gross negligence, riding under the influence, and use contrary to these terms — for example riding over the 150 kg maximum load.
  • We settle against the deposit first. If the amount exceeds the deposit, we send an invoice with photographs and an itemised breakdown.

11 Theft

  • If it is stolen, report it to the police and send us the report. Tell us as soon as you can, and in any case within 24 hours.
  • If you can produce both keys — the scooter’s and the supplied chain lock’s — you pay €100.
  • If either key is missing, you pay €400.
  • The distinction exists because a scooter that was genuinely locked is rarely stolen. It is the same approach Dutch bicycle insurers take, for the same reason.

12 Insurance and liability towards others

  • Damage you cause with the scooter to other people, to vehicles or to other people’s property falls under your own liability. Kruk op Wielen does not insure that for you.
  • So before you rent, check whether you have Dutch personal liability insurance (WA-verzekering) and whether it covers what you intend to do with the scooter. If you are unsure, ask your insurer. If you are new to the Netherlands: WA cover is not automatic and not included in your rent or health insurance — it is a separate, inexpensive policy that most households here have.
  • The amounts in the clauses above concern only damage to or loss of the scooter itself, and are separate from your liability towards other people.

13 Cancelling, changing and extending

  • Up to 24 hours before the agreed delivery time you can cancel or move your booking at no cost.
  • Cancel later than that and we charge one day of hire.
  • Want to keep it longer? Let us know before your period ends. If nobody is behind you in the calendar we extend it, and you pay the rate for the new total period.
  • Bring it back early and we charge the rate for the actual period, never more than you would originally have paid.
  • Renting as a consumer at a distance also gives you a statutory fourteen-day cooling-off period from the moment the booking is confirmed. If you ask us to deliver within those fourteen days, you are agreeing that we start before the period ends. Your cooling-off right then lapses once the hire has been fully performed; cancel earlier and you pay only for the days you had it.

14 Liability

  • We make sure the scooter is serviced and in good order at delivery.
  • We are not liable for damage resulting from use contrary to these terms, or from circumstances outside our control.
  • Our liability is in all cases limited to the amount you paid for the hire, except in the case of intent or gross negligence on our part, and except where the law does not allow such a limit — so it does not apply to injury or death.
  • Nothing in these terms limits your rights as a consumer under Dutch law.

15 Buying

  • You can also buy the scooter. The price is on the site; if you have already rented, half of the rent you paid comes off, up to the cap shown on the site.
  • You get a twelve-month guarantee on the motor, controller and frame. Wear parts such as tyres and brake pads are excluded.
  • Those twelve months are an additional guarantee from us and sit on top of your statutory rights. Your statutory guarantee under Dutch law — the right to a product that is what you may reasonably expect — is not reduced by it and has no fixed term. For second-hand goods there is in addition a statutory liability period of at least one year, and during that first year the burden of proof is on us: if a defect appears, we have to show it was not there at delivery.
  • Buying as a consumer at a distance gives you fourteen days to change your mind from the moment of delivery. Since we deliver in person and you try it on the spot you usually know straight away — but the right stands. Message us within those fourteen days and we collect it; you get the purchase price back.

16 Complaints and disputes

  • We would much rather hear a complaint directly, by phone or email. We reply within five working days.
  • Dutch law applies to this agreement. As a consumer you always keep the protection of the mandatory law of the country you live in.
  • If we cannot resolve something together, you can also raise it through the European ODR platform at ec.europa.eu/consumers/odr. Otherwise it goes to the competent court in Rotterdam.

17 Changes

  • We may update these terms. A hire that is already confirmed is always governed by the terms as they stood when it was confirmed.
